3.3 Holiday pay

The Labour Code sets out two methods for calculating holiday pay payable to an employee, requiring employers to compare the results, paying the more favourable result to the employee:

  1. Ìý

    •ÌýÌýÌýÌý 1/10 method (or 1/10 rule): total of the employee's gross earnings for the qualifying period during which the paid leave was earned, multiplied by 10%

  2. Ìý

    •ÌýÌýÌýÌý salary maintenance method: calculate the 'theoretical salary' that the employee would have received if they had come to work.
