In terms of the individual employee, the employer must follow due process and prove the facts of the case beyond reasonable doubt. Failure to follow this process will be punished in the courts – any dismissal will be presumed to be unfair. It is essential therefore that a qualified French HR professional supervise any dismissal.

If the employer proposes to make two employees or more redundant, the position is deemed to be a collective redundancy and the employer must consult the works council regarding the proposal. The purpose of the consultation is to give the employee representatives an opportunity to comment on the proposal and suggest alternatives.
