Legally enforceable maintenance payments made for the benefit of the other spouse are tax deductible for the payor for income tax purposes. The maintenance paid is taxable in the hands of the recipient (TCA 1997, s 1025).
In this context the term maintenance payments refers to payments made on foot of a Court order, by agreement or by other act giving rise to a legally enforceable obligation when the marriage
