9.1ÌýÌýÌýÌý Employment law overview

Under the Non-Citizen (Employment Restriction) Act, a non-citizen cannot engage in any occupation in Mauritius for reward or profit, or be employed in Mauritius, unless they have a valid permit and they engage in the occupation or is employed in accordance with the conditions which are specified in the permit.

A person who commits an offence under the Non-Citizen (Employment Restriction) Act shall, on conviction, be liable to a fine of not less than MUR 100,000 but not more than MUR 500,000 and to imprisonment for a term not exceeding five years.

Thirteenth month bonus

An end of year statutory bonus (commonly known as the 'thirteenth month') has to be paid by the employer to the employee and is not discretionary to the employer. The laws which govern the end-of-year bonus are the Worker's Right Act 2019, which covers person drawing a monthly basic wage or salary of not more than MUR 100,000, and the End of Year Gratuity Act 2001, which caters for employees earning a basic salary of more than MUR
