This topic looks at the legal framework that underpins UK immigration control and the government department that manages it.

Home Office

The Home Office is responsible for all aspects of control of the UK border and of the entry and stay of foreign nationals who require leave (permission) to enter and remain in the UK.

Any decision to grant or refuse leave to enter, entry clearance or leave to remain is made by the Home Office on behalf of the Secretary of State for the Home Department (SSHD). The Home Office also considers applications for British citizenship. Passport applications are handled by a separate part of the Home Office, His Majesty's Passport Office.

The immigration control work of the Home Office is split into three areas:

    UK Border Force—which manages applications for leave to enter at the border and customs functions

  2. •

    UK Visas and Immigration—which deals with applications for entry clearance and leave to remain, asylum applications, appeals and sponsor management for the Worker, Temporary Worker and Student immigration routes

  3. •

    Immigration Enforcement—which is responsible for investigating immigration offences, detention, administrative removal

ICIBI launches call for evidence on asylum decision quality inspection

The Independent Chief Inspector of Borders and Immigration (ICIBI) has launched a call for evidence as part of its inspection of asylum casework quality. The inspection focuses on various aspects of Home Office asylum decision-making processes, including the clarity of guidance, the effectiveness of communications with claimants, the conduct of substantive interviews, the quality of decisions, and stakeholder engagement. Submissions from individuals with relevant knowledge or experience are invited until 2 July 2025. While the inspection does not extend to individual cases, such cases may be referenced as indicators of broader systemic issues. All contributions will be fully anonymised in the final report.

Home Office appoints first Windrush Commissioner to oversee scandal reforms

The Home Office has appointed Reverend Clive Foster MBE as the inaugural Windrush Commissioner, effective for an initial three-year term. This newly created role is tasked with independently overseeing the government’s initiatives to address the Home Office Windrush scandal, ensuring that the voices of victims play a central role in shaping reform. Reverend Foster, a senior pastor with deep community ties and a personal connection to the Windrush legacy, will lead efforts to redress past injustices and drive systemic reform. This appointment forms part of the government’s Plan for Change, which is further reinforced by a £1.5m compensation fund for affected individuals and the re-establishment of the Windrush Unit to prevent future errors.
